Amendment in the Nature of a Substitute 



The amendment in the nature of a substitute (AINS) would replace the text in H.R. 1599, the Safe and Accurate Food Labeling Act of 2015, as introduced. It would ensure national uniformity regarding labeling of foods derived from genetically engineered plants by preventing a patchwork of conflicting state or local labeling laws which inherently interfere with interstate and foreign commerce. The AINS would provide for a system of orderly marketing of agricultural products through the development of national, enforceable standards for labeling claims touting the inclusion or exclusion of genetically engineered ingredients.

The proposed bill addresses both consumers' interest in having additional information about their food products and industry's need for uniform rules by creating a national certification program for foods that have been produced without genetic engineering. The bill would define a non-genetically engineered food to include foods that are not produced from, do not contain, and do not consist of a genetically engineered plant. The proposal is modeled after the successful National Organic Program. Under the proposed program, certifying agents accredited by the USDA would certify that a food was produced with or without genetic engineering in compliance with a genetic engineering plan designed to ensure the integrity of the label. The Secretary of Agriculture would establish the certification requirements by rulemaking, including public input.
